We are thinking on establishing a business in China. However before that we would like to know what are the requirements for getting the title of producer and to get the certificate of origin of China.

Would be grateful if you could give any guidance or reference that particularly deals with this issue.

Dear Oybek,

1) How to set up a company in China
You can read the following links to know the process and documents to set up business in China, as you would need to export through this company, so you can consider either JV or Wholly Foreign Owned Enterprise(WFOE). You would need to set up the company first, then to apply for export license.

Useful links:

Remarks: They provide company formation service, the information is very thorough, their fee is on the high end though.

Remark: A very respectable blog by a Qingdao based US lawyer

2) How to apply for COO(certificate of origin)
In china, every company(including JV, WFOE) can apply for import and export license. After you get the import/export license, then you can registered your company at local Entry-Exit Inspection and Quarantine Bureau to apply for qualitification to issue COO, after getting that approval, they will give you a software so you can input and print the information for COO, but each time you need to go to Entry-Exit Inspection and Quarantine Bureau so they can stamp on the document to make it effective.

Alternatively, we normlly ask the shipping agent to arrange the COO or Form A at a few hundred of RMB, to avoid the complicated procedure.

Hope this helps.
